VA Nursing & Pumping Laws
Virginia earns a top score of 3 out of 3 on Mamava's Breastfeeding State Scale, thanks to layered protections covering public breastfeeding, indecent exposure, workplace accommodation, and schools.
Public breastfeeding: Va. Code § 2.2-1147.1 guarantees a mother the right to breastfeed her child anywhere she's lawfully present, including any property owned, leased, or controlled by the state.
Indecent exposure exemption: Va. Code § 18.2-387 explicitly states no person violates the indecent exposure statute by breastfeeding in a public place or any place where others are present.
Workplace accommodation: As of 2020 (HB 827/SB 868), Virginia employers with five or more employees cannot discriminate on the basis of pregnancy, childbirth, or related medical conditions, including lactation, under the Virginia Human Rights Act. This requires employers to provide "reasonable accommodations" — unpaid break time and a private, non-bathroom lactation space.

Public breastfeeding: Under the DC Human Rights Act of 1977, mothers have the right to breastfeed anywhere they and their child are legally allowed to be, regardless of whether the breast is covered — and breastfeeding mothers are explicitly exempt from public indecency laws.
Workplace pumping: DC law requires employers to provide reasonable, unpaid break time and a sanitary space (not a bathroom) close to the work area for expressing milk. This runs alongside the federal PUMP Act, giving DC employees dual coverage.
Employer obligations: Employers must create a written breastfeeding policy and post it visibly in the workplace. Violations can be reported to the DC Office of Human Rights within one year (180 days for DC government employees).

MD Nursing & Pumping Laws
Public breastfeeding: Maryland law (Md. Health-General Code § 20-801) states a mother may breastfeed her child in any public or private location where she and the child are authorized to be, and no one may restrict or limit that right.
Workplace pumping: Maryland has no additional state-level workplace lactation law beyond the federal PUMP Act, so breastfeeding employees rely on the FLSA protections — reasonable break time and a private, non-bathroom space for up to one year after birth.
Local exception — Baltimore City: Baltimore City passed its own Lactation Accommodations in the Workplace Ordinance in 2019, requiring city employers to provide dedicated lactation accommodations beyond what state law mandates.
Reporting violations: Noncompliance can be reported to the Maryland Attorney General's Consumer Protection Division.
